Søren Kierkegaard coyly noted:
People demand freedom of speech as a compensation for the freedom of thought which they seldom use.
Interestingly, among this dower Dane’s works were theological investigations into Christian ethics. Were Kierkegaard alive today, he would be feverishly scribbling notes about the subject of today’s Supreme Court ruling that centers around a lowly pack of self-proclaimed “primitives” called the Westboro Baptist Church. What sadly substitutes for their alleged ethics can only be described as primitive.
The Supreme Court ruling … not at all.
Westboro’s waste of protoplasm conduct sidewalk “protests” outside of funerals, completely indifferent to the grief of those gathering to bury loved ones (strike one on the Christian ethics roster). Speaking for Gawd, as theological thugs are want do, Westboro’s congregation of rhetorical gangsters hold signs and yell slogans like “God hates fags”, “God hates Jews” and “God is angry every day” (strike two), which if anything is an inelegant display of transference.
I have no idea what Gawd thinks, but then again neither does pastor Fred Phelps. I’m just man enough to admit it.
As un-Christian as their behavior is, in a free society people have the right to display their idiocy, though Congress takes this freedom to extremes. Free speech provides that Westboro halfwits can say whatever is in their alleged minds providing they do so within appropriate “time, place and manner.” Since Phelps’ Fools stay on the sidewalk, don’t obstruct traffic, and don’t get physical with grieving parents, widows and children, Westboro’s blockheads retain the right to be offensive. Today the Supreme Court ruled as such, with a decision that said nothing kind about the “church” but maintained the sanctity of one corner of the Constitution.
All this ruckus brings home a theological question and doubt about the existence of Gawd. Unexplainable irony has always been Gawd’s trademark. One would think the pastor – whose life work is to spread “God’s hate” (strike three) – might be a tempting target for the Almighty. Perhaps Gawd could arrange for Phelps to be bofoed by a bear or have a mohel re-circumcise him (small loss).
Better yet, forget them. Like other fleeting pimples on the buttocks of humanity, they too shall pass, and for troubling their own house shall inherit the wind (Proverbs 11:29).

Well, the members of the First Amendment Lawyer’s Association (of which I am a proud member) are congratulating both the trial lawyer and the appeals lawyer (both of whom are also proud FALA members) on the win. While joining in sentiment with Marc Randazza (also a FALA member) — see http://randazza.wordpress.com/2011/03/02/westboro-baptist-church-wins-first-amendment-is-preserved/ — we nevertheless continue our ever vigilant fight to protect the very constitution that so many are fighting to erode.
How long would the ‘church of Phelps’ continue to protest if the local constabulary weren’t in attendance to protect them?
Remove the official sanction, and the distasteful behavior will go away.
